Talky Terms of Use

Version: 2026-10-14 · Effective: 14 October 2026

These terms govern your use of the Talky mobile app provided by Ata Kılıç, an individual based in Türkiye ("we", "us"). Ata Kılıç provides the service and Talky Plus.

When you first open Talky, you read these terms and check the box "I have read and accept the Terms of Use"; we record the version you accepted and when. How we process your personal information is covered not by these terms but by the Privacy Policy and the KVKK Notice.

1. The service

Talky is a diction and speaking-practice app with lessons, exercises, exams and automated feedback based on your recordings. Content and features may change over time.

2. Not a medical service

Talky is for general diction and speaking practice. It is not a medical product or therapy service: it does not diagnose or treat speech disorders, does not replace a speech-language pathologist, and does not guarantee any particular result. If you have a health concern about your speech, talk to a professional. Stop any exercise that strains your voice or causes pain or discomfort. Don't enter health information in the app.

3. Automated measurements

Feedback is based on automatic transcription and measurement of your recordings. Background noise, your microphone or the speech itself can throw measurements off; results are estimates meant to guide you, not an expert assessment. Exam results and certificates show your level within Talky only and are not an official credential.

4. Age and your account

To use Talky you must be at least 18 if you live in Türkiye, or at least 13 if you live anywhere else. If you live outside Türkiye and are between 13 and 17, you may use Talky only with the permission of a parent or guardian. By accepting these Terms you confirm that you meet the age requirement. If we learn that you are under the age limit, we delete the account.

You sign in to Talky with your Apple or Google account. You are responsible for keeping it secure and for activity under it. You can delete your account in the app at any time (Profile › Settings › Account and data › Delete account); details are on Delete your account.

5. Acceptable use

If these rules are broken, depending on how serious the breach is, we may warn you, suspend the account or close it. You can challenge a closure by writing to ata@kilicov.dev.

6. Talky Plus and subscriptions

7. Your content and recordings

Your recordings and what you write belong to you. You allow us to use them only to provide the service (transcribe, measure, show them to you). How we process recordings and when we delete them is in the Privacy Policy.

8. Intellectual property

The app, lessons, texts, images, sample audio and the Talky brand belong to us or our licensors. You may use them only within the app for personal, non-commercial practice. You are free to share your certificate card.

9. Availability

We aim to keep the service running and error-free, but maintenance, outages or third-party services can interrupt it. We may change or remove features; if we remove a paid feature, we will act within store rules and applicable law.

10. Liability

We provide Talky with care. We are not liable for damage that is not caused by our fault, including damage arising from inaccurate automated measurements, your device or internet connection, or outages of third-party services such as Apple's or Google's. Our liability for intent and gross negligence, any liability that cannot be limited by law, and your rights as a consumer remain unaffected in every case.

11. Changes

We may change these terms. We show material changes in the app and ask you to accept them again; you can't keep using Talky without accepting the new version, but you can always delete your account and cancel your subscription. Minor changes, such as wording fixes, are published here with a new version date.

12. Governing law and disputes

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Türkiye have jurisdiction. If you are a consumer, you may apply to the consumer arbitration committee where you live or where you made the purchase, within the monetary limits set each year by the Turkish Ministry of Trade, and to the consumer courts above those limits. If you live outside Türkiye, the mandatory consumer protection rules of your country of residence still apply.
